Supported by a team of NEC Project Managers and Quantity Surveyors the Project Commercial Manager (Works Contracts) will be responsible for:
- Managing the commercial aspects of the project works contracts.
- Working collaboratively and constructively with the Project Team and the supply chain to develop effective relationships and drive project success.
- Developing and assuring commercial reporting across these contracts.
Key tasks, activities and responsibilities of the role
Main Scope of Responsibilities:
Contract Management:
- Lead the contract administration of various works contracts including Mechanical, Electrical & Instrumentation and various Civils work mainly operating under NEC forms of contract.
- Monitor contractor performance, ensuring compliance with contractual obligations, timelines, and quality standards.
- Change Control: Advise the project teams with regards to Project Manager’s Instructions, Early Warnings, Compensation Events and Quotations and make recommendations to the Senior Project Leadership team in relation to the same.
- Oversee and manage the payment application process, including accurate progress measurement and timely issuance of payment notices, payless notices, etc.
- Work closely with the Project Controls team to ensure accurate cost management and reporting, including the development of and preparation of regular cost reports, cash flow forecasts, and budget monitoring.
- Identify any potential cost overruns and work closely with the project team to implement corrective actions as necessary.
- Ensure that any potential commercial risks are identified and mitigated promptly.
- Ensure full adherence to the terms of all contracts, including NEC-based agreements, with a focus on avoiding disputes and ensuring contractual compliance.
- Work closely with the legal team to review and negotiate contract terms, manage claims, and resolve any contractual issues that may arise.
- Where required, support the Senior Commercial Manager in resolving any claims, disputes, or disagreements and defending formal claims for any additional time or cost.
- Provide regular updates to senior stakeholders on commercial performance, risks, and opportunities.
- Ensure that all commercial documentation is well-organized and accessible for audits and reviews.
- Liaise with the Senior Commercial manager, Project Directors and other Senior Management to support decision-making and address any commercial challenges.
- Provide guidance and direction to the Commercial Team of NEC Project Managers and Quantity Surveyors.
- Ensure compliance with the organisations policies and procedures and ensuring they remain both fit for purpose and reflect current requirements.
- Provide commercial awareness training to project-based staff members.
- Ensure the maintenance of accurate contracts & procurement commercial records in line with the organisations and statutory requirements.
- Maintain positive and constructive relationships within the organisation, clients and suppliers alike.
- Contribute to the development of the Company culture and values
To be successful in this role you should have:
- A degree in Quantity Surveying, Construction Management, Engineering, or a related field (or equivalent).
- 15+ years of experience in a project commercial management role within the construction or energy sectors, with experience managing large, complex projects.
- Strong understanding of NEC forms of contract, including cost management, change management, and claims processes.
- Experience managing multiple contractors across different scopes, with particular expertise in managing MEI and Civil works.
- Previous experience managing a strong commercial project team.
- Strong commercial acumen and negotiation skills.
- Excellent communication and interpersonal skills, with the ability to interact with various stakeholders, including contractors, senior management, and suppliers.
- Ability to manage and resolve disputes and commercial challenges effectively.
- Strong organizational and time management skills, with the ability to manage multiple priorities.
- Chartered status with RICS (Royal Institution of Chartered Surveyors) or another relevant professional body.
- Additional qualifications and experience relating to construction law and adjudication.
