Commercial and Procurement Lead

The Commercial and Procurement Lead will report to the Senior Project Commercial Manager and will be part of a major, commercial-scale construction project to build a stability Island and long-duration energy storage facility in Carrington.
 
Supported by a Procurement Manager and Procurement Specialist the Commercial and Procurement Lead will be responsible for:
  • Maintaining the Procurement Plan for all UK based activities and ensuring all contracts are placed in line with the project schedule.
  • Performing the Commercial Panel Secretary role.
  • Provide commercial advice, direction and guidance to Package Leads across various contracts ranging from consultancy services, logistics services, materials and equipment supplies.
  • Assuring adherence to processes and procedures across the project.
  • Developing and assuring commercial reporting across these frameworks and contracts.
  • Developing and maintaining a comprehensive contract register for the project.
  • Liasing with Finance and Accounts payable (3-way match).
  • Working collaboratively and constructively with the Project Team and the supply chain to develop effective relationships and drive project success.
 
Key tasks, activities and responsibilities of the role
 
Main Scope of Responsibilities:
 
UK Procurement:
  • Maintain the UK Procurement Plan ensuring that all activities are included and planned so as to maintain project schedule.
  • Delivery of all procurement activities in line with the plan.
  • Reviewing of all tender documentation including draft contracts at key stages of the process to ensure quality and the appropriate apportionment of risk in selected contracts.
  • Lead the negotiation of terms and conditions jointly with legal.
  • Ensure that all necessary documentation is stored appropriately.
  • Be a key point of contact for all framework contracts.
  • Assure adherence to process across all procurement activities.
Commercial Panel Secretary:
  • Lead the Commercial Panel meeting supported by the Procurement Manager.
  • Review of all submissions prior to panel and advise the Senior Project Commercial Manager and Project Director in relation to the same. 
Commercial Advice, Direction and Assurance:
  • Ensure control of spend across various frameworks and contracts
  • Provide guidance, assurance and direction to the package leads in relation to all aspects of commercial management of their frameworks and contracts.
  • Change Control: Advise support and direct the Package Leads in relation to the administration of change and claims under their contracts.
  • Take the lead on complex contractual matters including claims negotiation.
  • Oversee the payment application/invoicing process, to ensure spend to date is recorded and payments are made in compliance with contract.
  • Work collaboratively with Finance and Accounts Payable to ensure 3-way match.
Process and Assurance:
  • Track and monitor process assurance across the project and rectify none compliance.
  • Drive process compliance throughout and assurance of the same.
  • Support the further development of processes and procedures for the Commercial Function.
Cost Management & Reporting:
  • Work closely with the Project Controls team and the package Leads to ensure accurate cost management and reporting, including the development of and preparation of regular cost reports, cash flow forecasts, and budget monitoring.
  • Identify any potential cost overruns and work closely with the project team to implement corrective actions as necessary.
  • Ensure that any potential commercial risks are identified and mitigated promptly.
  • Develop and maintain a comprehensive contract register for the project.
  • Develop and maintain a comprehensive Supplier Register and Assurance Tracker
Contractual & Legal Compliance:
  • Ensure full adherence to the terms of all contracts, with a focus on avoiding disputes and ensuring contractual compliance.
  • Work closely with the legal team to review and negotiate contract terms, manage claims, and resolve any contractual issues that may arise.
  • Where required, support the Senior Commercial Manager in resolving any claims, disputes, or disagreements and defending formal claims for any additional time or cost. 
Stakeholder Communication & Reporting:
  • Provide regular updates to senior stakeholders on commercial performance, risks, and opportunities.
  • Ensure that all commercial documentation is well-organized and accessible for audits and reviews.
  • Liaise with the Senior Project Commercial Manager, Project Directors and other Senior Management to support decision-making and address any commercial challenges.
General Functional Activity:
  • Provide guidance to the Procurement Manager and Procurement Specialist.
  • Ensure compliance with the organisation’s policies and procedures and ensuring they remain both fit for purpose and reflect current requirements.
  • Provide commercial awareness training to project-based staff members.
  • Ensure the maintenance of accurate contracts & procurement commercial records in line with the organisation’s and statutory requirements.
  • Maintain positive and constructive relationships within the organisation, clients and suppliers alike.
  • Contribute to the development of the Company culture and values
 
To be successful in this role you should have:
  • A Commercial, or Procurement background, degree qualified.
  • 15+ years of experience in a similar role within the construction or energy sectors, with experience managing large, complex projects.
  • Able to quickly interpret and understand various standard form and bespoke contracts.
  • Experience managing multiple frameworks and contracts.
  • Strong commercial acumen and negotiation skills.
  • Excellent communication and interpersonal skills, with the ability to interact with various stakeholders, including contractors, senior management, and suppliers.
  • Ability to manage and resolve disputes and commercial challenges effectively.
  • Strong organizational and time management skills, with the ability to manage multiple priorities.
 
It would be really valuable if you have:
  • Chartered status with RICS (Royal Institution of Chartered Surveyors) or CIPS or another relevant professional body.
  • Additional qualifications and experience relating to contract law and adjudication.
